In Their Own Words

PL

Puan Lailatul Husna

George Town, Penang

My late husband passed without a will and I did not know where to begin. The team at Tinggalan Adil walked me through the process step by step. They were never impatient when I asked the same question more than once.

What relieved me most was knowing that the syariah portion was handled alongside the civil estate, not as an afterthought. Everything concluded within fourteen months.

Mr. Tan Chong Wei

Tanjung Tokong, Penang

I wanted a will done properly — one that accounted for the property I hold in Penang and the unit in Singapore. Other firms I contacted either said they could not assist with the overseas element or gave me a quote without properly reading my situation.

The solicitor here took time to understand the full picture before recommending anything. The two-stage process was something I had not encountered before, and it made a genuine difference.

Encik Radzuan Kamaruddin

Butterworth, Penang

Our family situation was unusual — my father's estate included a contested nomination from a second marriage. I was not looking forward to the process, but the practice approached it calmly.

They were honest about the strength of our position and did not encourage us toward a longer fight than was necessary. We reached a settlement that all parties could accept, and the family is on speaking terms still.

Puan Suraya Norizan

Bukit Mertajam, Penang

I came in wanting to prepare a will after my mother's estate took nearly three years to sort out. I did not want my own children to go through the same thing. The consultation was thorough — they asked questions I had not thought to ask myself.

The draft came back clearly written. I had a fortnight to consider it. There were two things I wanted changed, and both were accommodated without any difficulty.

Mr. Darren Venugopal

Bayan Lepas, Penang

My father's estate was modest but included property and a unit trust account that required different processes. The practice handled the High Court petition and the asset transfers efficiently and kept me informed throughout.

One thing that stood out: when the land registry delayed a transfer for reasons beyond the firm's control, they chased it on our behalf rather than waiting for us to follow up.

Puan Azizah Hamdan

Seberang Jaya, Penang

I had concerns about whether my will would be understood correctly after I am gone — particularly regarding my wishes for a property I share with my brother. The solicitor explained exactly how this needed to be structured and why.

The fee was exactly as quoted. No surprises. I have since referred my sister to this practice as well.

Three Matters, Briefly Described

Case Study I

Intestate Estate with Dual Civil and Syariah Assets

The Situation

A Muslim father of four died without a will. The estate included a terraced house, an investment account, EPF savings, and two takaful policies. The family were unfamiliar with how the civil and syariah distributions interacted and came to us having received contradictory advice from two sources.

How It Was Handled

We mapped all assets and explained clearly which fell under civil intestacy and which under syariah faraid. A syariah practitioner was brought in for the faraid portion. The civil probate was filed concurrently. Both processes proceeded on separate but coordinated tracks.

The Outcome

Both portions were concluded within sixteen months. Each beneficiary received a clear final account explaining what they had received and from which part of the estate. The family remained on good terms throughout.

Case Study II

Cross-Border Estate with Singapore and UK Property

The Situation

An elderly woman died leaving property in Penang, a condominium in Singapore, and a small investment portfolio in the United Kingdom. Her Malaysian will did not address the overseas assets explicitly, and two beneficiaries were resident abroad.

How It Was Handled

We obtained the Malaysian grant and used it as the basis for resealing in Singapore through a correspondent firm. For the UK portfolio, a separate UK solicitor was engaged under our coordination. All three processes were managed from this office so the family dealt with one point of contact.

The Outcome

All three jurisdictions were concluded within twenty-two months. The family avoided the confusion of managing three separate legal engagements in different countries. Overseas beneficiaries received their distributions without needing to travel.

Case Study III

Will Challenged on Grounds of Undue Influence

The Situation

A deceased person's earlier children challenged a will that substantially benefited the deceased's late-life partner. The challenge was based on alleged undue influence in the final years of the deceased's life, and there were medical records and correspondence to examine.

How It Was Handled

We were instructed on behalf of the executor. We reviewed the medical records, engaged a medical expert on the question of testamentary capacity, and prepared the case thoroughly. Before proceedings commenced, settlement discussions were initiated. Both sides were represented in a structured mediation.

The Outcome

A negotiated settlement was reached before any court hearing. The settlement reflected a revised distribution that all parties were prepared to accept. Full court proceedings were avoided. The estate was wound up six months after settlement.
