The Situation
A Muslim father of four died without a will. The estate included a terraced house, an investment account, EPF savings, and two takaful policies. The family were unfamiliar with how the civil and syariah distributions interacted and came to us having received contradictory advice from two sources.
How It Was Handled
We mapped all assets and explained clearly which fell under civil intestacy and which under syariah faraid. A syariah practitioner was brought in for the faraid portion. The civil probate was filed concurrently. Both processes proceeded on separate but coordinated tracks.
The Outcome
Both portions were concluded within sixteen months. Each beneficiary received a clear final account explaining what they had received and from which part of the estate. The family remained on good terms throughout.

The Situation

The Situation

How It Was Handled
We were instructed on behalf of the executor. We reviewed the medical records, engaged a medical expert on the question of testamentary capacity, and prepared the case thoroughly. Before proceedings commenced, settlement discussions were initiated. Both sides were represented in a structured mediation.
The Outcome
A negotiated settlement was reached before any court hearing. The settlement reflected a revised distribution that all parties were prepared to accept. Full court proceedings were avoided. The estate was wound up six months after settlement.
